1. Introduction
   1. These ABC Cargo & Courier BWM Prize Draw Terms (the Terms) set out the terms on which you can enter the ABC Cargo & Courier BMW Prize Draw to win a BMW car (the Prize Draw).
2. The Promoter
   1. The promoter of the Prize Draw is ABC Cargo & Courier UK Limited, a company registered in England and Wales with company number 14852569 and a registered address at Unit C4 Green Lane, Heathrow Corporate Park, Hounslow, England, TW4 6ER (the Promoter).
3. How to enter
   1. The Prize Draw will run from 9:00am GMT on 20 November 2024 (the Opening Date) to 11:59pm GMT on 20 February 2025 (the Closing Date) inclusive.
   2. The Prize Draw is open to you if you are a customer of the Promoter and you pay to use the Promoter’s courier services.
   3. Each customer who, between the Opening Date and Closing Date, uses and pays for courier services provided by the Promoter, shall automatically be entered into the Prize Draw. You may opt out of entering the Prize Draw by emailing the Promoter prior to the Closing Date, without having to give any reason: promotions@abccargo.uk 
   4. The number of entries into the Prize Draw that you receive will be determined by the amount you pay the Promoter for courier services, excluding Value Added Tax. You shall:
      1. Receive one entry into the Prize Draw for each increment of £100 you pay the Promoter for courier services; and
      2. Receive one entry into the Prize Draw if you pay the Promoter less than £100 for courier services.
   5. By way of illustration if you pay:
      1. £55 you will receive one entry into the Prize Draw;
      2. £155 you will receive two entries into the Prize Draw;
      3. £200 you will receive three entries into the Prize Draw;
      4. £255 you will receive three entries into the Prize Draw;
      5. £478 you will receive five entries into the Prize Draw; and
      6. £1,518 you will receive 16 entries into the Prize Draw.
   6. You will only be entered into the Prize Draw once the Promoter has received payment into its own bank account. 
   7. You will not receive entries into the Prize Draw for any payments received by the Promoter after the Closing Date. If the Promoter has not received payment for an order by the Closing Date, then any entries into the Prize Draw that you received related to that order will be cancelled. The Promoter shall not be responsible if it has not received payment due to technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
   8. If for any reason the Promoter is required to refund you part or all of a payment, then:
      1. where the Promoter makes a full refund, all entries into the Prize Draw that you received will be cancelled; and
      2. where the Promoter makes a partial refund, you shall only receive entries into the Prize Draw based on the amount not refunded and in accordance with conditions 3.4 and 3.5.
   9. You are deemed to have accepted and agreed to be bound by these Terms upon entry into the Prize Draw. The Promoter reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these Terms.
   10. The Promoter reserves the right to hold void, cancel, suspend, or amend the Prize Draw where it becomes necessary to do so.
4. Eligibility
   1. The Prize Draw is only open to all residents in the UK aged 18 years or over, except:
      1. employees of the Promoter or its holding or subsidiary companies;
      2. employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Prize Draw or its administration; or
      3. members of the immediate families or households of (a) and (b) above.
   2. In entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.
   3. A condition of entering the Prize Draw is that, if you are the winner, then you consent to taking part in media coverage of winning the Prize Draw (Winner Announcement). 
   4. The Winner Announcement shall include the winner being photographed and videoed accepting the Prize (described at clause 5 below), with such photos and videos potentially being:
      1. posted publicly on social media platforms including Instagram, Tiktok and Facebook; and 
      2. distributed to mainstream print and online media. 
   5. If you do not consent to the Winner Announcement and therefore wish to opt out of entering the Prize Draw, then please confirm that you wish to opt out by emailing the Promoter prior to the Closing Date, without having to give any reason: promotions@abccargo.uk
5. The prize
   1. The winner of the prize draw will receive a BMW car with the following specification:
      1. F44 218i M Sport Gran Coupe B38 1.5i
      2. Colour: black sapphire
      3. Trim: Black Trigon Cloth/Sensatic
      4. Fuel type: petrol
      5. Engine capacity (CC): 1499
      6. No. of doors: 4,

the Prize.

2. There is only one Prize for this Prize Draw.
3. The Prize is supplied by Marsh Wall Limited whose address is Berry Chiswick, Unit 10-11, Syon Gate Way, Great West Road, Brentford, TW8 9DD. The Promoter reserves the right to substitute the Prize with a prize of equal or greater value.
4. The Prize is not negotiable or transferable.

6. The Winner
   1. A winner will be chosen by random draw performed by a computer process on 24 February 2025 at 11:00am GMT (the Draw Date).
   2. The winner will be notified by email or telephone (using details provided to the Promoter) on the Draw Date and must provide a postal address to claim their prize. If a winner does not respond to the Promoter within three business days of being notified by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
   3. The Prize must be collected by the winner, from the Promotor’s registered address set out above, on 2 March 2025, or such other date reasonably agreed between the Promoter and the winner. The winner must take part in the Winner Announcement when collecting the Prize, as set out above at clauses 4.3-4.6. 
   4. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of the Prize Draw winner on its website https://abccargo.uk/news-and-events/ on 24 February 2025.
   5. If you object to any or all of your surname and county being published or made available, please contact the Promoter by emailing promotions@abccargo.uk. In such circumstances, the Promoter must still provide the information to the Advertising Standards Authority on request.
   6. The decision of the Promoter regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.
7. Limitation of liability
   1. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
8. Data protection and publicity
   1. The Promoter will only process your personal information as set out in the privacy policy: https://abccargo.uk/privacy-policy/. See also conditions 4.3-4.6 and 6.4-6.5 above, with regard to the announcement of winners.
9. General
   1. If there is any reason to believe that there has been a breach of these Terms, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Prize Draw.
   2. The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize Draw where it becomes necessary to do so.
   3. These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
10. Free gifts
    1. Each customer who, between the Opening Date and Closing Date, uses and pays for courier services provided by the Promoter, will be eligible for a free gift (Gift).
    2. A Gift shall be a single item of up to £20.00 (TWENTY GBP) in value and may include items such as t-shirts and clocks.
    3. A Gift shall be awarded for every paid invoice between the Opening Date and Closing Date. 
    4. Once awarded, a Gift shall be sent to the customer by post within 30 calendar days from the Closing Date.
